These general terms and conditions regulate the contractual relationship between Wine & Co, registered under VAT BE0897668187, whose main activity is the sale of wines, and the customer, who provides the services and goods orders from Wine & Co. Any situation that is not foreseen by our general or special terms and conditions is governed by the generally applicable legal regulations. The Commercial Practices Act dd. 14/7/1991 and the Civil Code are used as the basis for the establishment of relations with the consumer prior to the conclusion of the contract.

Orders via the website of Wine & Co. are always made subject to acceptance of the general terms and conditions.

Wine & Co. has the right not to process inaccurate or incomplete order forms.

Renunciation clause

The consumer has the right to inform the seller that he is renouncing the purchase without penalty and without giving any reason, within 14 working days from the day following the delivery of the product or the conclusion of the service agreement. The consumer must then return the goods at his own expense, after which Wine & Co. will refund the purchase price.

Alcohol & Responsibility

We do not sell alcohol to persons under the age of 18. With your order you hereby declare that you are responsible for your purchase and that you are over 18 years old.

Delivery

For transport costs within Belgium, Wine & Co. charges € 15 if the total amount of the order is less than € 150. No transport costs will be charged for all orders over € 150..

Delivery takes place within 5 working days after receipt of payment, unless stated otherwise on the site or on the order confirmation. The customer is always obliged to check the number of packages received before signing the delivery note. After signing off, this is no longer possible for discussion. In the event of a change of address, the customer is obliged to immediately inform Wine & Co.

Customers must be 18 years or older and the legal confirmation of this is both when purchasing online and when delivering the goods. If the person who receives the goods does not meet this requirement on delivery,Wine & Co. has the right to request compensation for the shipping costs associated with the delivery.

Wine & Co. is not liable for damage as a result of exceeding delivery times. If your order is not in stock, you will be contacted about the delivery time. If the delivery time is not acceptable to you, the order will be automatically canceled.

Prices

The prices and rates are in Euro currency and apply per bottle, in the case of packs per pack, in accordance with the statement on the website at the time of the order or while stocks last.

Wine & Co. has the right to change prices and to correct any typing errors. If you are disadvantaged by this, you will be notified by e-mail. You then have the right to cancel your order. In addition, Wine & Co. can change prices if these price changes are the result of objective circumstances (VAT, goods tax, packaging material, transport and so on).

All offers from Wine & Co. are without obligation. Offers are made subject to availability of the wine. When a product is no longer available, you will be contacted and an alternative can be offered. You then have the right to cancel your order.

Payment

After you have placed and shipped your order, you will receive an email confirmation and an invoice or by post if a correct email address is not provided.

Payment is done:

– via credit card or bank contact on our website

– by bank transfer to BE36001821348081 (it is important to add your order number).

Delivery takes place after receipt of payment.

Invoices must be paid to a bank account number specified by Wine & Co. In case of partial delivery, the customer undertakes to pay for the already delivered according to the pricing on the invoice. Complaints regarding the invoice must be reported to Wine & Co. by e-mail within 7 days of the invoice date.

If one or more invoices are not paid or paid too late as well as in case of bankruptcy, administration, collective debt settlement and any other indication of manifest incompetence or incompetence, Wine & Co. reserves the right to refuse orders, it can also suspend a current order, as long as invoices have not been paid or have not been paid in full, without Wine & Co. being or can be held liable for any compensation.

Guarantee

For visible defects (glass breakage, flaws, etc.), the customer must immediately upon delivery, otherwise a complaint based on this is no longer valid. The customer must also notify Wine & Co. by e-mail within 7 days after delivery.

All wines are covered by the Wine & Co. guarantee. If a delivered wine does not meet the expectations of the customer, he is free to have the wine collected, not returned, by Wine & Co. under the following conditions:

– the customer must contact our customer service by e-mail (info@wineco.be),

– only full boxes and undamaged bottles are eligible for return. The customer may have opened a maximum of 1 bottle of the same type from only one box for tasting.

If the conditions set are met, the customer will be refunded the amount paid within 14 days after collection by Wine & Co. to the bank designated by the customer, in the absence thereof, to the bank account that made the initial payment to Wine & Co.

The invoiced transport costs remain payable even when the goods are collected.

Situations of Calamity

Wine & Co. is never liable for situations of calamity or any other cause beyond its control (war, strike, lockout, breakage, theft, fire, logistical problems at transporters and third parties, etc.) that could lead to Wine & Co. cannot or not timely fulfill its obligations, although it will always endeavor to execute the agreement with delay if necessary without being or could be obliged to pay any compensation.

Disclaimer

Information on the website is offered to the customer subject to typing and printing errors or other material errors. Interim changes, both in terms of products and prices, are always possible. Images of bottles or labels may vary. The customer is therefore always invited to regularly consult the website for the latest version of our terms and conditions. Wine & Co. accepts no liability for the consequences of possibly incorrect or changed information, nor for actions performed by third parties.
